Regular Meeting

PZC2011-50 Application for Amendment to Special Permit to use upper level for office and a space for therapeutic massage at 11 Phelps Way (Map 30 Lot 14 Zone DC) (Received October 24, 2011 Public Hearing or Decision by December 6, 2011)

M. Ellis said the application is to add use of the upstairs space for office space and therapeutic massage.  M. Ellis asked the number of therapists that would be using the space and Mr. Dellaripa said one for right now and potentially two.  He said the room is 12x12 and will hold one table.  The office space will be 8x6 and Mr. Dellaripa showed this on the plans.  

S. Yorgensen said the applicant would have to get approval from the Fire Marshal.  The commission agreed it was a minor modification and would not require a public hearing.  

A. Marco commented that during the public hearing the space was discussed and the public was fully aware of a possible use.  

Old Business

PZC2011-47 Application Special Permit &Site Plan Approval for 24 units for Elderly Residents at 60 Old Farms Road (Map17 Lot 1 Zone DER) Owner: Town of Willington Applicant: Willington Housing Authority (Received Sept 20, 2011P.H. Public Hearing October 18, 2011 P.H. closed Oct 18, 2011 Decision by Dec 6, 2011.)

A discussion was held on a draft motion.  The commission discussed gaps in the plans, HVAC, fuel type, and the storage location that was not delineated on the plans.  A discussion was held on Jacobson & Associates recommendation of increasing the size of the existing 24” pipe that was detailed in their previous report.  J. Poole mentioned fire protection and sprinkler requirements and S. Yorgensen said that would be fire and building code.  

A discussion was held on the abandonment of the previous septic.  S. Yorgensen said they will abandon the leech field but the tank will be incorporated into the new systems.  The commission discussed the following regarding the draft motion; changes come before the commission, mow strip and technical changes recommended by the engineer to be incorporated in the plans.  

S. Yorgensen will email the draft motion to the commission.

PZC2011-48 Application Special Permit for Home Occupation Tax Service at 12 Laurel Dr (Map 53 Lot 20-41 Zone R80) Owner/Applicant: James & Diane Bulick (Received Sept 20, 2011 Public Hearing October 18, 2011 P.H. closed Oct 18, 2011 Decision by Dec 6, 2011.)

M. Ellis motioned to approve PZC2011-48 with the following conditions:

  • There shall be no on street parking.
  • Business shall be conducted on an appointment only basis.
  • Any signage shall conform to the zoning regulations and shall come back before the Commission.
  • Permit shall be annually renewable beginning December 1, 2012.
W. Parsell seconded the motion.  All in favor.  Motion carried.

The commission agreed that the application was a minor modification based on prior approval and a public hearing was not needed.  

A. Marco motioned to approve PZC2011-50 in accordance with all conditions of the original/current permit.  All building permits are to be obtained and approval received by the Fire Marshal.  E. Standish seconded the motion.  All in favor.

Minutes

J. Poole motioned to approve the minutes with the following modification; the applicant will abandon the septic field but not the septic tank that will be incorporated into the new system.  W. Parsell seconded the motion.  M. Ellis abstained.  All others in favor.  Motion carried.

Correspondence

1.  Senate Bill No. 859 regarding extending the time of expiration of certain land use permits.  
A discussion was held on the extension.  S. Yorgensen said an Inland Wetland permit could be for 9 years and extended for as long as 14 if the applicant comes in before the permit expires.  

Staff Report

S. Yorgensen had nothing additional at this time.  

A discussion was held on enforcement of outside storage.  J. Poole asked if staff was starting to get caught up.  S. Yorgensen said she is continuing to work on P & Z enforcement and IWWC enforcement.   

J. Poole commented that his term is coming to an end.  The commission will send a letter to the Board of Selectmen.  M. Ellis added Election of Officers to the December 6, 2011 meeting.
